In accordance with the Law dated 9 January 2026 No. 257-VIII, employers will be subject to administrative fines for violations related to the Unified System of Employment Contracts (USOEC) starting 12 March 2026.
What violations will be subject to fines?
A new paragraph 1-1 has been added to Article 98 of the Code of Administrative Offences. Liability applies for:
- failure to enter information into the USOEC;
- late submission of data;
- incomplete submission of information;
- provision of incorrect or inaccurate information.
Amounts of fines
First violation
- Officials – 30 MCI (in 2026 – KZT 129,750)
- Small businesses and non-profit organisations – 60 MCI (KZT 259,500)
- Medium-sized businesses – 80 MCI (KZT 346,000)
- Large businesses – 150 MCI (KZT 648,750)
Repeated violation within one year
- Officials – 60 MCI (KZT 259,500)
- Small businesses and non-profit organisations – 80 MCI (KZT 346,000)
- Medium-sized businesses – 100 MCI (KZT 432,500)
- Large businesses – 200 MCI (KZT 865,000)
What information must be entered into the USOEC?
In accordance with Order of the Minister of Labour and Social Protection of the Population of the Republic of Kazakhstan dated 3 September 2020 No. 353, the following information must be entered into the system:
- employee’s IIN;
- employer’s IIN or BIN;
- position and job function;
- place of work;
- term of the employment contract;
- start date of employment;
- date and number of the employment contract.
The absence of any of the above information is considered incomplete submission of data.
Deadlines for submission of information
Order No. 353 establishes the following deadlines:
- New employment contract – no later than 5 working days from the date of signing;
- Amendments and supplements to the contract – no later than 15 calendar days;
- Termination of employment – no later than 3 working days.
Failure to comply with the above deadlines entails administrative liability under Article 98 of the Code of Administrative Offences.
Can an error be corrected?
The employer has the right to correct incorrectly entered information within 30 working days.
If the error is not corrected within the established period, administrative liability will apply.
Who is responsible for maintaining the USOEC?
The obligation to enter information rests with the employer or with an employee appointed by order as the person responsible for maintaining the system.
The absence of an appointment order does not exempt from a fine.
What should businesses pay attention to?
The introduction of fines for violations related to the USOEC significantly increases risks for employers, particularly where there is no systematic control over HR documentation processes. Even technical errors, missed deadlines or incomplete data submission may result in substantial financial penalties, including for repeated violations.
HR departments and accounting teams are advised to conduct an internal review of USOEC data submission processes, formalise responsibility by order, establish deadline control procedures, including reminders and double-checking of data, and ensure timely correction of errors within 30 working days. Regular audits of HR procedures will help minimise risks and avoid fines.
